5. What does the facility control include?
According to Clause 3 Article 57 of Circular No. 38/2015 / TT-BTC dated March 25, 2015 of the Ministry of Finance, contents of inspection of production facilities include:
1. Checking the address of the processing or manufacturing establishment: check the address of the processing or manufacturing establishment as stated in the written notice of the processing or manufacturing establishment or in the business registration certificate.
2. Inspect factories, machines and equipment:
a) Checking documents proving the legal use rights of workshops and production premises; warehouse and yard for raw materials, supplies, machinery and equipment.
b) Examining the ownership or the lawful right to use of machinery and equipment, the number of existing machines, equipment and production lines at the processing and manufacturing establishment; check the operational status, capacity of machines and equipment.
When conducting inspection, the customs office checks the customs declarations of imported goods (in case of import); invoices and vouchers of buying machinery and equipment or comparing the accounting books to determine (in case of domestic purchase); financial lease contract (in case of financial leasing); rental contract of property, factory (in case of rental). For financial lease contracts, property lease contracts, factories, the effective term of the lease contract is equal to or longer than the effective term of the contract to export products.
3. Check the status of the human resources involved in the production line through contracts signed with employees or payrolls to be paid to employees.
4. Checking through the accounting book system to monitor the warehouse or the software to manage imported and exported goods, inventory of raw materials, supplies, machinery and equipment.
